TERMS AND CONDITIONS

 

 

DEFINITIONS   In these Terms And Conditions the following words have the following meanings:

“We, Us, Our” means Pegasus Promotions. Co. UK.

“You, Your, Yourself” means the person, persons, or company to which We supply Products.

“Products” means any items/products/goods ordered by You from Us, to be supplied by Us to You.

“Contract” means any contract between Us and You incorporating these Terms And Conditions.

“Working Days” means all days other than Saturdays, Sundays, and public holidays.

“International” means anywhere outside of UK jurisdiction.

“Consumer” means any natural person who in a Contract to which these Terms And Conditions apply, is acting for purposes outside  his business.

“Accept Payment” means the time at which You pay via credit or debit card through Our website or the moment at which Your funds have cleared in to Our account via cheque, postal order, bankers draft, international money order, bank to bank transfer or the moment at which We receive cash.

CONSUMER TERMS AND CONDITIONS

 

All Products must be paid for in full in advance of delivery.

You may only purchase products through this website if You are 18 years of age or older on the day at which We Accept Payment from You.

When We Accept Payment from You, You enter in to a Contract.  This Contract conforms to the Consumer Protection(Distance Selling)Regulations which came in to force on 31st October 2000, they apply and extend to all areas within UK jurisdiction including Northern Ireland.  The Contract ends on the day after delivery of Your Product.

None of these Terms And Conditions affect your statutory rights when purchasing within the UK and Northern Ireland.

International customers are welcomed.  International laws may differ from those of the UK.

PRODUCT SPECIFICATIONS

Each Product offered has a clear and original image created by Us from a typical example of each.

Any descriptions offered are as clear and correct as possible at the time when We Accept Payment from You.

UNAVAILABILITY

Although every endeavor is made to ensure that Our full stock range is available at all times, there may be occasion when it is not possible to send the requested Product.  In this case We shall inform You.  You will have the option of being provided a substitute Product of equivalent quality and price or You can cancel the Contract and request reimbursement which will be given as soon as possible and in not more than 30 days from the date of request.  In the event You take a substitute product and then cancel the Contract and return the Product to Us, the cost of returning the substitute product to Us will be met by Us.

PRICE

All Products are priced correctly at the time We Accept Payment from You.

All Products are inclusive of VAT.

All Products are subject to delivery costs unless stated otherwise or unless specific arrangements have been made for personal pick-up by You from Our place of business.

PERFORMANCE

Unless otherwise agreed We shall perform the Contract within a maximum of 30 days beginning with the day after the day on which We Accept Payment.  In the event that We are unable to perform the Contract in this 30 day period we shall inform You and reimburse any fees paid in respect of the Contract which shall be treated as if it had not been made.

GUARANTEE

All Products are supplied with the manufacturer’s guarantee unless otherwise stated.

We guarantee that Products will be free from defects in materials and/or workmanship for a period of 12 months(or longer if required by law)beginning on the day on which the Contract is completed unless otherwise stated.

We shall be under no liability in respect of any faults or defects caused by willful damage, abnormal conditions, failure to follow instructions, misuse, alteration or repair of Products without Our express approval, improper maintenance or negligence by Your part or by a third party.

CANCELLATION

In the event that You want to cancel a Contract for any reason You have the legal right to do so.  Should You wish to cancel, You must do this within the cancellation period.  The cancellation period begins on the day after the product is received by You, it ends 7 Working Days after.  You must give Us notice of cancellation by post or email to obtain authorization before returning any Product to Us.  Notification must be received within the cancellation period for Us to treat it as having been properly given.  Notification is deemed to have been given on the day on which it is posted or emailed.

On Our acceptance of Your cancellation notice the Contract shall be treated as if it had not been made.

On the cancellation of a Contract We shall reimburse any sum paid by You in relation to the Contract, less any recovery fees if applicable.  We shall make payment to You as soon as possible within a period not exceeding 30 days beginning with the day on which cancellation was given.

EXCEPTIONS TO CANCELLATION

Exceptions to the right to cancel include:

Products of which the price is dependent on fluctuations in the financial market which can not be controlled by Us.

Products which have been made to Your specifications or clearly personalized or which by reason of their nature can not be returned or are liable to deteriorate or expire rapidly.

Audio or video recordings or computer software if they are unsealed by You.

Newspapers, periodicals or magazines.

RETURN OF PRODUCTS

In the event of a Contract being cancelled after You have acquired possession of any Product, You are treated as having been under a duty throughout the period prior to cancellation to retain possession of the Product and to take reasonable care of it.

On cancellation You shall be under a duty to restore the Product to us in accordance with our request at Your own expense unless returning a Product through unavailability.

WHOLESALE CUSTOMERS

 

Should You wish to purchase Products through this website You must contact Us for verification.  On verification You will be given login details and a password.

 

Wholesale customers are encouraged to visit our warehouse, but this is strictly by appointment only.

All Products are inclusive of VAT at the current rate of 17.5% unless stated otherwise.
